Stauber Votes No on Pelosi’s Unconstitutional Gun Grab

March 11, 2021

WASHINGTON, D.C. – Today, Congressman Pete Stauber (MN-08) voted against H.R. 8 and H.R. 1446, two Democrat-led bills that would make it increasingly harder for law-abiding citizens to exercise their Second Amendment rights and do nothing to prevent criminals from accessing firearms.

Of both bills, Congressman Stauber stated, "It's unbelievable that just one week after Pelosi and her allies in Congress voted to eliminate critical resources for the police and make our communities less safe, they are now pushing forward legislation that would prevent law-abiding citizens from protecting themselves and their families. As a victim of two-violent gun crimes, I know firsthand that criminals who are willing to take someone's life do not care about gun laws. That's why I will never vote for legislation that will erode the Second Amendment and prevent law-abiding Americans from exercising their right to self-defense."

H.R. 8, also known as the "universal" background check bill, would criminalize the private transfer of firearms. Specifically, it would subject law-abiding gun owners to criminal penalties for simply handing a firearm to another person. For example, if someone simply wanted to loan his or her rifle to a long-time friend to go skeet or trapping shooting, he or she could face a year in prison and a $100,000 fine. The same would be true if he or she loaned an abuse victim a firearm for self-defense.

H.R. 1446 would eliminate the 3-day proceed to sale provision currently mandated under federal law. Without this provision, the FBI has no incentive to complete background checks in a timely manner and would allow the federal government to delay the sale of a firearm for an indefinite period of time, preventing law-abiding citizens from exercising their right to keep and bear arms.
